In this report we introduce readers to Two YouTube videos, which read as if they describe two different tax systems.

In the first, Scott Kuru warns that the capital gains overhaul due in July 2027 will land hardest on people who do not think of themselves as investors: part-time workers, carers, people easing into retirement.¹

In the second, Punters Politics argues that Australia’s gas exporters are banking a war windfall that the Commonwealth has chosen not to tax, and that a government short of revenue will look to everyone else.²

Both videos are opinion, and both contain claims Osprey could not verify. But their central arguments survive a check against the Budget papers, industry modelling and Senate evidence.
Together, they raise one question: when the government shifts the economic burden, who is protected and who is left exposed?

The policy mechanics are straightforward.
Starting 1 July 2027, the 50% capital gains tax [CGT] discount for individuals, trusts, and partnerships will be replaced by inflation indexation of the cost base, paired with a new 30% minimum tax on the resulting real gain.³

This change only applies to future gains, leaving pre-July 2027 gains protected under the old discount system. However, pre-1985 assets — previously exempt from CGT entirely — will now be taxed on gains accrued after the start date, and discretionary trusts will face a separate minimum tax.⁵
Meanwhile, negative gearing will be restricted exclusively to new property builds, grandfathering existing properties held on Budget night.³

The Government argues that taxing only real gains restores the system’s original intent.³ The legislation has now passed both houses, complete with Senate amendments that exempt testamentary trusts and allow certain small-business shareholders to opt into either the old or new regime.⁶

The real Policy Sting is the 30% minimum tax floor. While Treasury notes¹ that indexation protects investors whose gains barely beat inflation, the 30% floor overrides lower personal tax brackets.
Consequently, low-income earners are the most exposed.

Modelling by the Financial Services Council highlights this impact:

• Part-time worker: A 53-year-old working part-time after a redundancy who realises a $15,000 real gain will see their tax jump from $1,050 to $4,500 solely due to the floor.

• Young investor: A younger investor holding a diversified ETF portfolio will see their effective tax rate on long-term gains spike from 7% to 19.1%.

The Bill Nobody Counted

Scott Kuru’s second argument is about cost that never reaches the Treasury.
CPA Australia estimates that complying with the tax system costs about $60 billion a year, within a range of $54 billion to $70 billion.

Businesses with turnover under $100 million carry about $31 billion of it, individuals about $16 billion and large corporate groups about $10 billion.⁹ That is roughly 2% of GDP, and taxpayers spend about $13 complying for every dollar the Government spends administering the system.^10,11
A Board of Taxation review into cutting tax red tape, delivered to the Government in June, has still not been released.¹⁰

The new CGT rules add to that load, and here two official-looking numbers collide. Treasury’s regulatory impact assessment puts the ongoing cost of the capital gains and negative gearing changes at $88.4 million a year.

CPA Australia’s bottom-up analysis puts it at $295 million to $542 million a year, plus a one-off transitional valuation cost of at least $675 million to $825 million that it says Treasury has not disclosed.⁸

The Option on the Table

The second video is where the argument turns from Tax Burden to Bonanza alternative.

Punters Politics points to gas, and the numbers behind the claim are real.

LNG export earnings are now forecast at $65 billion in real terms, against $47 billion predicted last December, an extra $18 billion attributed to the continuing Middle East Conflict - which continues to escalate.¹⁶

Against that, the Petroleum Resource Rent Tax, the main levy on offshore gas, raised about $1.45 billion last financial year, according to the industry body Australian Energy Producers.¹³ Independent senator David Pocock and the Australia Institute campaign for a flat 25% tax on gas exports.

The Prime Minister has called the claim that gas is exported tax-free “disingenuous”, and ruled out a levy before the Budget; a Senate inquiry found the PRRT ineffective, but the Government declined to touch it.^13,15

Both sides have a case, and Osprey sets them out plainly. The industry says the sector is already Australia’s second-largest corporate taxpayer, paying $21.9 billion in taxes and royalties last financial year, and Woodside told the Senate a flat 25% export levy would be economically unsustainable and would make its Browse project uneconomic.^13,14

The Prime Minister’s position is that the PRRT lets companies recover their investment first and will ramp up as costs are paid down.¹⁵

Critics answer that a profit-based tax on a business whose export earnings have been as high as $90 billion has yielded little, and that a windfall created by a war is a fair target.¹⁴

The Diesel Fuel Connection

This is where a tax argument becomes a fuel-security story. In the Budget, the Government did not raise gas export taxes, and it had ruled out changes beforehand. SBS reported that LNG exports were reportedly being used as leverage in negotiations with trading partners to shore up liquid fuel supplies, and that Labor was wary of angering key fuel suppliers who rely on Australian gas.¹⁵

Osprey’s earlier investigations showed why that logic has force: Australia imports roughly 90% of its diesel, mostly through Asian refiners in countries such as Japan and South Korea, which are also major buyers of Australian LNG.

That connection cuts both ways. If gas is a bargaining chip for diesel, then a gas tax decision is also a fuel decision, and the public deserves to see the trade-off stated openly rather than inferred from a report on what the Government is reportedly doing.
A windfall of this size, and a diesel market this tight, make the question harder to avoid. How much of Australia’s fuel security is being bought with revenue the Government has chosen not to collect, while other taxpayers are asked to supply more?

Does This Smell Like Blackmail?

Who Carries the Windmill?

Osprey takes no position on the right rate for any of these taxes.

The question is consistency.

A system that puts a hard floor under the gains of a part-time worker, leaves the cost of its own tax-reporting complexities unmeasured, and declines to touch a war windfall, will always invite the charge that its principles are already crippled & it depends upon who is holding the the “Diesel Gun to Australia’s Head.”

The Government should answer that charge, and the evidence above suggests it has answers on at least two of the three counts, but chooses to keep the Voters in the Dark.

What it has not yet done is publish the Board of Taxation review, reconcile its compliance estimate with the accountants’, or explain in public what, if anything, gas tax policy is being traded for in the fuel market.

On 2 October 2026, the average price of diesel in Britain reached 200.01 pence a litre, the first time it has crossed £2 at the pump.¹ Filling a 55-litre family car now costs £110.01, up £31.70 since 28 February, the day before the US-Iran war began.²

The same week, the Trump administration told European governments to release strategic diesel reserves “immediately”, floated a US diesel export ban if they refused, and watched the G7 agree to release 100 million barrels in response.3,4

Those two stories are the same story. A new forward-looking model from hydrocarbon analyst Karl Miller, published 3 October 2026, explains why draining a reserve is not the same thing as fixing the problem it was built for.⁵

The Record Nobody Wanted

UK transport minister Keir Mather insisted the country was not facing a diesel shortage, a point made specifically in response to Donald Trump’s threat to cut off US supplies.¹
That distinction, between a shortage and a price shock, is the heart of this investigation. There is no queue at British service station forecourts. There is a global market in which the marginal barrel costs far more than it used to, and Britain, which imports more than half the diesel it burns, pays that marginal price on every litre.⁵

The Diesel Reserve War

On 1 October 2026, the US told European allies to release strategic diesel reserves “immediately” to bring global prices down, with EU states due to discuss a coordinated response the next day.³
Treasury Secretary Scott Bessent pressed the point publicly; Trump told reporters he “may” formally request it.⁴ A European official told Politico that Washington’s proposal asked for 120 million barrels over 180 days.⁷ The alternative on the table was a US diesel export ban, which analysts said could remove close to a third of the world’s seaborne diesel supply with one stroke of the pen.⁷

On 2 October 2026, the G7 announced a coordinated release of 100 million barrels of diesel fuel reserves, short of the 120 million Washington had asked for.⁴
Trump told reporters Europe had “agreed to release a massive amount” of diesel.⁴ Most of Europe’s emergency diesel sits in Germany and France, and France’s own presidency said no formal demand had been made of Macron directly when he met Trump at the UN.³

The French response captures the mood: an agreement in principle, delivered under open threat of an export ban, with the practical mechanics still being worked out.

Why a Reserve Is Not a Repair

This is where Karl W. Miller’s new model, shared by Larry C. Johnson on 4 October 2026, changes the picture.

Miller’s argument is that a ceasefire can reopen a shipping lane overnight, but it cannot manufacture a compressor, mobilise commissioning engineers, or pay a contractor.⁵ Rebuilding the Gulf’s damaged energy infrastructure is, in his words, a competition for cash, equipment, qualified contractors and finished fuel, not a problem that ends with a diplomatic announcement of a peaceful resolution.⁵

His cost model runs from;

• Under $500 Billion, in a fast-recovery case, to

• $1.16 Trillion in his aggressive case, and,

• As high as $2.53 Trillion if the rebuild proceeds under prolonged stress, with scarce equipment and rising prices.5

Miller is explicit that these are model outputs, not contractor quotes; an April 2026 assessment had put energy-related repair costs at only $34-58 billion, a small fraction of his own range.⁵

The timeline matters as much as the cost: weighted by spend, the rebuild averages almost five years from today, only 60% of the work is done by 2031, and the longest-lead equipment packages run to seven years.⁵

Miller’s most original point is about cash, not just steel, materiel & concrete.
A damaged refinery can be technically repairable and still sit idle, because the government that owns it must pay for food imports, salaries, electricity and water before it pays an engineering contractor.5

Iraq illustrates the trap: in July it faced a monthly public salary bill of about
$5.96 Billion against a funding shortfall of $2.52 Billion.⁵ A government in that position rebuilds nothing. It pays its people, and the export capacity that would restore its revenue waits in line behind payroll demands.

The Barrels That Are Actually Missing

The scale of the shortfall is already visible in trade data. Gulf diesel net exports in August were just over a quarter of prewar levels. Combined Gulf and Russian diesel exports sat 1.6 million barrels a day below February.
Global oil stocks have fallen 507 million barrels since the war began, and global refinery throughput in August ran 4.2 million barrels a day below the same month a year earlier.⁵

In his severe case, Miller models a shortfall of at least 3 million barrels a day of diesel and jet fuel, every year, for five years; this equates to about 1.1 billion barrels a year, 5.5 billion barrels in total.⁵
He calls it a stress test, not a forecast, and notes a faster-recovery path closes the gap by year four.5 But he is equally clear that no country’s emergency stocks were built to cover a gap that size for that long, which is exactly the mechanism now playing out between Washington and Europe.⁵

Europe’s Perishable Cushion

This is where the G7’s 100-million-barrel diesel pledge runs into a problem Miller spends real time on: diesel is not crude oil.
Crude can sit in a salt cavern for decades. Conventional ultra-low-sulfur diesel typically lasts six to twelve months in storage, extendable to 18-24 months with chemical stabilisers and well-managed tanks, before oxidation, sediment and microbial growth set in.5

The EU’s own road-diesel standard allows up to 7% biodiesel, which oxidises faster still; Concawe, the refiners’ research body, recommends a maximum six-month storage life for blends containing biodiesel.⁵

That perishability changes what a “diesel reserve” really is. It is not a stockpile a government fills once and forgets; it is stock that must be continually rotated, sold into the market, and replaced with fresh fuel on a one-to-two-year cycle.5 Every barrel Europe releases now under US pressure has to be bought back later, in the same tight market Miller describes, from suppliers who are already short.

A reserve with an eighteen-month shelf life cannot cover a structural deficit Miller’s severe case puts at five years.⁵

Who Replaced the Persian Gulf?

Europe’s exposure runs deeper than the reserve question. The continent burns about 5 million barrels of diesel a day; EU refineries, running flat out, can supply 4.5 to 5 million, leaving it 85-90% self-sufficient at best, with the remaining margin, roughly 580,000 barrels a day of imports, setting the price for the entire market.⁵

Since March, the United States has supplied more than half of Europe’s diesel imports, and more than two-thirds of imports in August and September.5
Europe has swapped dependence on Moscow for dependence on Washington, and Washington has just demonstrated it is willing to use that leverage.⁵

The crude behind that diesel tells the same story twice over. The EU imports about 97% of the crude it refines, and the Gulf was never its main source: Gulf Cooperation Council states supplied only about 7% of EU crude imports in 2025, Iraq another 5.8%.5 The United States, Norway and Kazakhstan together supplied nearly half of EU petroleum imports in the second quarter of 2026, and while the volume held steady, the bill rose 56%.⁵

Much of Europe’s refining capacity was built for medium-sour crudes like Russia’s Urals; American shale-crude is light and sweet, refines readily into petrol, and yields proportionally less diesel, the very product in short supply.⁵ Even the non-American barrels carry risk: most Kazakh crude reaches Europe via the Novorossiysk terminal on Russian soil, a route already hit by Ukrainian drones.⁵

The Mechanism Behind the Price

Miller’s explanation for why prices move faster than volumes is simple: when supply falls short, buyers bid for the marginal cargo, and that bid sets the price for every barrel still being bought, not just the missing ones.⁵
A $40-a-barrel premium across 10 million barrels a day of global purchases adds $146 billion a year to the world’s fuel bill; applied only to the 3 million barrels actually missing, it would add $43.8 billion, understating the real cost.⁵

Scarcity reprices credit too: at $150 a barrel, a buyer holding 15 extra days of inventory on 1 million barrels a day needs $2.25 billion in financing; at $200, $3 billion.5

A cargo that wins a bidding war for one buyer leaves another buyer short, which is precisely the competition now playing out between Washington and Brussels over the same reserve barrels.

Britain’s £2 litre is not an isolated national story. It is the leading edge of a shortage Miller models running for up to five years, being managed in its first weeks by asking Europe to spend down a reserve that cannot be refilled quickly and was never designed to last that long.

How We Got Here

After Prime Minister Billy Hughes visited the Western Front in World War I, he understood that national survival and modern war-fighting depended entirely on oil and fuel. In 1920 the Commonwealth Oil Refinery [COR] was built at Laverton in Victoria in a joint venture with Anglo-Iranian Oil.

This investigation maps where Britain’s diesel actually comes from, what the exemption means, and why the date that matters for the UK is not March 2027 but the first day of the 2027 New Year.

The Refineries That Are No Longer There

Britain’s exposure is a story of closures. The Petroineos Grangemouth refinery in Scotland shut in April 2025, removing about 150,000 barrels a day of capacity; as the country’s only refinery with a hydrocracker, it is estimated to have supplied roughly 15% of UK diesel at its peak.⁵
The Prax Lindsey refinery closed the same year.⁶
Only four refineries remain: Fawley, Humber, Pembroke and Stanlow, down from nine in 2000, with combined capacity of about 1 million barrels a day against product demand of 1.35 million per day, in March 2026, of which 61% is diesel and jet fuel.²

Fuels Industry UK figures cited by CNBC show Britain imported 2.5 times as much diesel as it produced in 2024, in a fuel where it was self-sufficient as recently as 2011.⁶

Who Supplies Britain Now

The gap is filled from a shifting mix of sources. Since the 2023 embargo, the Netherlands has been the largest supplier of oil products to the UK, followed by the United States, with Kuwait rising from 2022 to 14% of imports in 2024; Saudi Arabia is an important source of diesel and heating oil.⁷

Kpler data put UK imports of middle distillates, meaning diesel plus jet and kerosene, at 483,000 barrels a day in 2025, with India, Kuwait, Saudi Arabia and the UAE together supplying 35%.²

S&P Global data show about a third of the roughly 200,000 barrels a day of diesel and jet fuel Britain imported in 2025 came from the Middle East Gulf.⁸

The Back Door

The May 2026 measure was billed as closing the “refinement loophole”, under which crude of Russian origin could be refined in India or Turkey and the diesel sold to Britain legally.^11,10
The Minister told the House of Commons the regime was tougher than the day before and that no existing sanctions were being lifted.¹⁰

Yet the general licence, in force from 20 May 2026, with no end date at the time, exempts diesel and jet fuel refined from Russian crude in third countries, which law firm Harneys describes as the two categories making up the vast majority of the UK’s refined Russian-origin imports.¹¹
Ministers defended it as a sensible decision to protect supply for industry, airlines and households; a Ukrainian opposition lawmaker called it deeply disappointing.²

One compliance analysis reads the carve-out as a recognition of the supply pressure from the Hormuz disruption.¹²

How much diesel actually sails through that door is not known.
In 2025 the UK took an average of 7,000 barrels a day of Indian gasoil, against 32,000 bp day of Indian jet and kerosene.⁸ The direct effect appears modest.

The precedent matters more: Britain’s sanctions policy gave way to supply security in a single announcement, and the stated end date, 1 January 2027, is now the pressure point.

The American Connection

This is where Johnson and Miller’s analysis, the subject of our Australian Investigation, lands squarely on Britain.

The United States is one of the UK’s biggest product suppliers, and Miller’s arithmetic shows it is running a small diesel deficit of about 62,000 barrels a day while exporting over 1.3 million, with Gulf Coast refiners preferring Europe and Latin America to their own East Coast because margins abroad are so high.1

For Australia, an American cutoff would remove a marginal, emergency channel.
For Britain it would remove a mainstream one.
Add the Gulf: about 60% of UK kerosene imports come from Saudi Arabia, the UAE and Kuwait, and Kuwait alone supplies 38%, which is why the Hormuz disruption cuts so deep.⁶

Diesel is less concentrated than jet fuel, but the Netherlands hub that carries the largest volumes is itself supplied from the same tight global pool.¹³

Diesel stands within 2p of its all-time record, up 38.6% since the Middle East conflict began on 28 February.¹⁴
physical buffer looks better than the price. DESNZ data show the UK held about 11.2 million tonnes of oil stocks in 2025, above the 90 days of net imports the IEA requires.¹³
But that measures total oil against net imports, not days of diesel.
One independent tracker, drawing on DESNZ figures, put commercial diesel cover at about 20 days on the latest — May 2026 data.¹⁵
Osprey treats that tracker as a secondary source, and its own correction note stresses the two measures cannot be compared. The takeaway is a comfortable strategic cushion sitting behind a thin operating one.

The Cliff Before March

Australia’s question was where diesel comes from if the US cannot supply it.
Britain’s is sharper and sooner.
If the licence lapses on schedule on 1 January 2027, cargoes refined from Russian crude in India or Turkey become illegal to land, in the middle of a global diesel squeeze and with Britain leaning on the very suppliers, Gulf and American, that Johnson and Miller show are constrained.
If the UK government instead extends the licence, it breaks its own public commitment to lift it at the earliest date, and Ukraine’s allies will notice.
Osprey does not forecast which way that goes.

The point is that the choice is being made on a
diesel market with no spare barrels in it.

America is drawing down its own fuel stocks, not sitting on a reserve it could send to a fuel-starved world.1 That finding matters far beyond Washington.
It matters in Fremantle, in Tamworth, and on every farm and mine site waiting on a diesel delivery.

This investigation takes Johnson and Miller’s numbers and asks the question they don’t: where does that leave Australia, if the U.S. genuinely has nothing left to give and the Gulf war runs past March 2027?

America’s Empty Reserve

Miller’s arithmetic is precise. In the four weeks to 11 September, U.S. refiners produced about 5.2 million barrels of distillate a day, running at 96.8% of capacity.¹ That looks enormous next to domestic demand of roughly 3.4 to 3.7 million barrels a day — a headline surplus of over a million barrels daily.
But for the week ending on 18 September 2026, after exports of 1.331 million barrels a day and domestic use of 3.975 million, the country actually ran a shortfall of about 62,000 barrels a day, made up from its own stockpile.¹

Refinery utilisation hit 98% in late August, the highest since 2018. There is no spare capacity left to turn on.

The stockpile that shortfall draws from is thin and badly located. Commercial distillate stocks stood at 107.9 million barrels on 11 September — about 30 days of cover, 12% below the five-year average — and the U.S. Energy Information Administration expects them to fall below 100 million barrels this month and stay below the five-year low through most of 2027.¹ East Coast diesel stocks were 33% below a year earlier at the end of August; the Lower Atlantic region, which supplies the U.S. Southeast, was down about 40%.

The surplus, such as it is, sits on the Gulf Coast — and Gulf refiners currently earn more shipping diesel to Europe or Latin America than to their own East Coast, because global crack spreads are near record highs.¹

The Cost of Moving Diesel

Two things are driving the price of diesel worldwide, and only one of them is crude oil. The first is refining margin: on 22 September 2026, Gulf Coast diesel traded at $209.66 a barrel against WTI crude at $96.41 — a gap of about $113 a barrel that reflects a bottleneck in refining and delivery, not in crude supply.1

The broader NYMEX 3-2-1 crack spread — the standard refining-margin benchmark — averaged around $69 a barrel in August, itself already far above the pre-2026 range of roughly $19 to $25.¹

The second driver is freight, and this is where the war has done most of its damage. The conflict has not shrunk the world’s tanker fleet — it has lengthened every voyage, as ships detour around danger zones, sail further for substitute cargoes, and idle offshore waiting for clearance.¹ Supertankers hauling Gulf crude to China were earning over $1 million a day in September, roughly 30 times their ten-year average.¹

Miller’s own arithmetic on why this matters is stark: stretch a tanker’s round trip from 30 days to 45, and the same fleet delivers only two-thirds as much fuel — meaning it would take 50% more ships just to hold deliveries steady.¹

Fewer tankers are even available for diesel specifically. The one class of ship that can carry either crude or clean products — the coated LR2 — has largely defected to crude, where day rates run three times higher; more than half the coated LR2 fleet was hauling crude by late April.1 The world is losing diesel-carrying capacity in the middle of a diesel shortage, which is precisely the mechanism behind the price spikes Australian motorists have been feeling at the bowser.

How This Reaches Australia

Australia was never the intended destination for America’s diesel. Its exposure runs through a different, more direct channel: the country imports roughly 90% of its refined liquid fuels, and only two refineries — the Ampol Lytton plant in Brisbane and Viva Energy’s Geelong facility — still operate onshore, together covering under 20% of national demand.²

Most of the remainder arrives from Singapore, South Korea and Japan — refiners who are themselves heavily supplied by Middle Eastern crude.² The Gulf war reaches Australian bowsers by one step of indirection, through Asian refiners’ own feedstock costs, rather than through any direct Australia-Gulf shipping route.

That exposure is visible in this year’s price trajectory. Average retail diesel across Australia’s five largest cities sat at 176.6 cents a litre on 20 February 2026, before the war began.
It peaked at 322.4 cents on 31 March 2026, after the Hormuz closure and a fire at the Geelong refinery, eased over winter, then climbed again as the conflict re-escalated — reaching 286.8 cents in the week to 23 September, up 18.9 cents in a single week.²

Independent analysis from Global Energy Flow, cross-checked against the Australian Institute of Petroleum’s national average, puts two scenarios on the table for the end of 2026: diesel near 305 cents a litre if the squeeze persists, or near 240 cents in a verified reopening — both well above the pre-conflict level, because global distillate stocks are expected to stay tight into 2027 regardless of which path plays out.²

Where Could Australia Turn To Next?

This is the question Johnson and Miller’s U.S. analysis doesn’t ask, because it isn’t about Australia, but America.
But it is exactly the question an Australian reader needs answered: if the Gulf war runs past March 2027 and the American “surplus” stays illusory, what actually stands behind Australia’s diesel supply?

The U.S. row deserves particular scrutiny, because it is where the public record contradicts itself. In April 2026, at the height of the crisis, energy analytics firm Vortexa tracked tankers carrying over 925,000 barrels of ultra-low sulfur diesel from the U.S. West Coast to Australia, with the U.S. reportedly supplying about 18% of Australia’s fuel that month.³

Yet the ACCC’s own weekly report for 23 September states plainly that Australia does not import a large amount of diesel from the United States.⁴

India’s Reliance Industries — operator of the world’s largest refining complex — is the more credible swing supplier. In March 2026, as the war disrupted Middle East supply and China banned refined product exports outright, Reliance-led shipments pushed India’s diesel exports to Southeast Asia to a seven-year high, with cargoes also reaching Australia.⁵

But India moved in the opposite direction days later, reimposing export taxes of roughly 21.5 rupees a litre on diesel specifically to protect its own domestic market.⁶

A supplier willing to tax its own exports at the exact moment global demand peaks is hardly a stable & reliable foundation for Australia. We need certainty for planning a Harvest Season, a mining contract schedule, or back-up Hospital Power Gensets in the event of Blackouts.

What If — March 2027 Arrives Like This?

Miller’s most important warning is not about today’s prices — it’s about the false comfort of a ceasefire. Even in his central case, where Gulf shipping resumes safely, roughly 11.8 million barrels a day of Gulf export capacity would still be unavailable a full year later, with restoration costing between $380 billion and $870 billion over five years.¹
Damaged wells, shared processing plants and specialist repair crews don’t move on a diplomatic timetable. Global Energy Flow’s own reopening scenario reaches the same conclusion from the Australian side: even its optimistic path keeps diesel roughly 50 cents a litre above pre-conflict levels, because distillate stocks stay tight into 2027 regardless of what happens at Hormuz.²

Osprey will not put a false number on March 2027 — nobody honestly can, and our earlier Investigation already flagged the danger of treating industry modelling as more precise than it is.
What both analyses agree on is the shape of the risk: a ceasefire announcement is not the same as barrels moving, and even a real reopening leaves Australia’s actual suppliers — Asian refiners still short of Middle East crude, an Indian swing exporter that taxes itself first, and a U.S. market with nothing spare to give — working through the same constraints for months or years after the shooting stops.

Somewhere between a US Gulf Coast refinery and a wheat paddock in the Western Australian wheatbelt, sits a number most Australians have never heard of;

• The Crack Spread — this is the price difference between the cost of a Barrel of Oil and the added cost of a Barrel of Refined Diesel.
  

On 17 August 2026, the U.S.Gulf Coast diesel crack spread — the margin a refiner earns turning crude oil into diesel — broke US$100 a barrel for the first time in history.1

Crude oil itself is not critically scarce. What is really scarce, is the world’s ability to turn Oil into the fuel that moves Australia’s freight, runs its mines, and — with the 2026 crop harvest bearing down upon us — brings in the grain.

Australia’s grain belt map — it is simple — No Diesel = No harvest - Get it?

If there is No Diesel — How will food get harvested & how will it get to the supermarket?

This is not a story about a shortage of oil. It is a story about a shortage of refining capacity, and about how exposed a country becomes when it has spent three decades closing its own refineries and outsourcing that capacity to Asia. ²

For Australian grain growers heading into the next harvest, with seeding windows measured in days, not months, the distinction is not academic. It is the difference between a paddock harvest completed on time and a crop written off for an entire year.

The Margin, Not the Oil

A crack spread is simple arithmetic: the wholesale price of a refined product minus the cost of the crude that produced it. Diesel is harder to refine than petrol — it requires specific hydroprocessing and catalytic cracking stages — so when refining capacity disappears from the global system, diesel prices respond faster and more sharply than petrol prices do. ³

For comparison, the broader NYMEX 3-2-1 crack spread sat around US$69 a barrel on the same day in August — itself already well above the pre-2026 range of roughly US$19 to US$25. ⁴

Two geopolitical shocks removed a material slice of global refining capacity at almost the same time. Russia suspended diesel and petrol exports through January 2027 after Ukrainian drone strikes crippled its refining infrastructure. ⁴

Conflict-related disruption around the Strait of Hormuz has simultaneously taken Middle Eastern refineries offline, tightening regional processing capacity further. ⁴

As Hedgeye Risk Management’s Daryl Jones put it, crude is not the scarce input — the ability to refine it is. 4

Australia’s Exposure: What the Government’s Own Data Shows

Australia closed six of its eight oil refineries between 2003 and 2021, leaving the Ampol Lytton plant in Brisbane and Viva Energy’s Geelong refinery as the country’s last two — both dependent on government subsidy to keep operating. ²

The consequence, laid out in the government’s own petroleum statistics and confirmed independently by NAB Economics, is stark: domestic refining now covers only 21% of Australia’s total refined fuel supply.
The remaining 79% is imported, up from roughly 30% in 2011. ⁵

Of the countries supplying that imported diesel, South Korea is the single largest identified source, accounting for 25% of Australia’s total diesel supply. ⁵

Domestically refined fuel now covers barely a fifth of Australia’s needs. The rest is bought on the open international market, at whatever the crack spread demands.

What is not in dispute is the direction of travel and the mechanism. Asia-Pacific refiners supply 96% of Australia’s imports, and those refiners overwhelmingly source their crude from the Middle East — meaning Australia is exposed twice over: once to Middle East crude supply, and again to Asian refining capacity. ⁵

With so little diesel produced onshore, Australian pump and bulk prices move with the international crack spread directly, not with the crude oil benchmark most price commentary still leads with. ⁸

Thin Reserves, Tight Timing

Australia’s buffer against exactly this kind of shock is thin by international standards. As of 2 June 2026, the government’s own Minimum Stockholding Obligation reporting showed 36 days of diesel reserve cover nationally. ⁹

Australia held the lowest oil stocks of any IEA member country in net-import-days terms in 2025, and remains the world’s largest single importer of diesel — representing an estimated 6.5% to 10% of global seaborne diesel trade despite having just 0.3% of the world’s population. ²

That reserve cover matters most against the calendar of the farm, not the calendar of the market. Western Australia delivered a record grain harvest in 2025, and the state’s Nationals have warned that record means nothing if growers cannot get fuel into paddocks to plant, spray and harvest in 2026 — noting diesel is the backbone of the entire agricultural supply chain, from tractor to truck to processor.¹⁰

A delay of even a few days during a seeding window can materially reduce yield; a two-week delay can make a crop non-viable, with no second chance within season parameters.¹¹

The Harvest Under Pressure

This is no longer a hypothetical risk. National Farmers’ Federation president Hamish McIntyre has said growers are already seeing tightening supply and rising costs for fuel and fertiliser, and warned that some may be forced to scale back plantings if that persists.¹²
The Federation has since called for a ministerial roundtable specifically on fuel supply, timed ahead of the harvest season beginning in late 2026.¹²

Treasury’s own modelling, cited separately, suggests a seven-day fuel shortage during peak harvest could cut agricultural GDP by 2.3% for that quarter alone.¹³

Geography compounds the risk. Large-scale Australian agricultural operations sit, by definition, at the end of long, thin regional supply chains. When national fuel supply tightens, distribution concentrates around metropolitan hubs first, and independent regional distributors — the ones actually serving farms — tend to be rationed first.¹³

The Australian Convenience and Petroleum Marketers Association has advised growers to check now whether their local supplier holds a contracted supply agreement or is exposed to spot pricing, precisely because peak demand periods like harvest and sowing are when that distinction bites hardest.¹⁴

Russia’s export suspension runs through January 2027. Middle Eastern refinery restarts depend entirely on political and military developments with no reliable timeline.⁴

Releasing strategic crude reserves — the standard policy lever for an oil price spike — does little to fix a refining capacity problem, since those reserves hold crude, not finished diesel.⁴

For a nation that closed most of its own refineries and now buys the finished product on the open market, that is a critical structural vulnerability and potentially an existential National Fuel Security Threat, not just a passing price cycle.

Let me show you exactly what Australia is repeating.

As geologist-run channel OzGeology put it bluntly: Australia found the oil, and so far, has done nothing with it. Santos, Carnarvon Energy, and Taiwan's state-owned CPC (via its subsidiary OPIC Australia) are now advancing exploration and drilling programs there through 2026 and beyond — building toward the kind of final investment decisions that, on past form, trigger exactly the pattern this investigation has documented: public loans, private ownership, and a tax outcome nobody can see coming until it's too late to fix.

This is the difference between Chapter 3 and what comes next.
Perdaman’s financing is already locked in — the $800 million is committed, the structure is set.
Bedout isn’t.
The ownership terms, the tax transparency requirements, and the public stake — if there is to be one — are still being decided.

The Three Demands above apply here with more force, not less, because this time WA has the chance to set the terms before the money moves, not after.

The pigs learned to walk on two legs once. Western Australia has now watched them do it twice. The question this series will keep asking is whether anyone in Perth is taking notes.

This chapter sets out, in concrete and enforceable terms, what a genuinely sovereign alternative would need to contain.

Every one of Napoleon’s amended commandments in Animal Farm started as a real, defensible principle. What corrupted them was never the wording — it was the absence of anyone with the power to hold the pigs to account, once they’d walked back inside the farmhouse.

Australia’s problem with resource governance is not that nobody has ever proposed strong terms. It is that every strong term proposed so far has arrived with a loophole attached, a sunset clause, or no enforcement mechanism at all.

Below are five principles — drawn from how the world’s more careful resource nations actually write their contracts — applied directly to the Perdaman refinery and the gas fields, — including Beetaloo — that would feed it.

Commandment One

In principle, Australia already has a version of this. Petroleum and minerals remain Crown property under state and territory law until they are severed from the ground — the same starting position Norway, Brazil and Angola all started from.

The difference is what happens next. In Australia, the moment resource crosses the wellhead flange, full commercial ownership transfers outright to the company, in exchange for nothing more than a royalty and a tax liability the PRRT has repeatedly failed to collect in practice.

In Norway, the state’s ownership does not end at the flange — the SDFI continues to hold a direct, undiluted financial interest in the produced hydrocarbons themselves, all the way through the sales chain.

Commandment Amended

The Crown owns the Resource until it is extracted.

The Crown owns a stake in the resource for the life of the project,
not just up to that moment, before it leaves the ground.

Applied to Perdaman: any new refining capacity approved from here forward should carry a mandatory state equity stake — not a subsidy, an actual ownership percentage — in both the refinery itself and the field supplying its crude, modelled on Petoro’s role in Norway rather than the Fuel Security Services Payments current downside-only guarantee.

Commandment Two — The Fiscal Revenue Waterfall

This is where Australia’s Royalties & Taxation regime is most visibly broken, and the numbers are not contested — they come from the Australia Institute, the Australian National Audit Office, and Treasury’s own PRRT Review.

Note: Figures vary slightly by source, depending on measurement year.

The Petroleum Resource Rent Tax [PRRT] was introduced in 1988 as a 40% tax on the “super profit” or economic rent from petroleum extraction.
It does not work as intended, for a specific, well-documented structural reason: companies are permitted to carry forward capital and exploration costs as deductions indefinitely, compounding each year through an “uplift rate” — functionally identical to compound interest working in the company’s favour rather than the State..

As economist Richard Denniss has observed;

“the Commonwealth collects more revenue from HECS fees than it gets from the Petroleum Resource Rent Tax.”

Following the collapse in PRRT revenue after 2002–03 — despite over $200 billion in new integrated gas investment, including the Gorgon project alone — the government’s own 2023 Treasury Review estimated that capping deductible expenditure could raise an additional $7 billion in receipts to 2033–34.

A genuine revenue waterfall, of the kind Norway, Angola and most serious resource-rent regimes use;

«pays gross value royalties before any cost recovery calculation begins — not after an unlimited, compounding stack of carried-forward deductions has already reduced the taxable base to near zero.»

Commandment Amended

Companies pay tax on their Profits.

The state is paid first, off the top, before any company
gets to argue about its profit numbers.

Commandment Three — Cost Recovery Caps & Auditing

This is the direct enforcement mechanism behind Commandment Two, and Osprey has already documented what happens without one.

In The Beetaloo Trap, this publication reported the INPEX average tax rate of just 0.70% over a decade, using Michael West Media’s own tax transparency data.
That outcome is not an accident or an aggressive one-off — it is what an uncapped, unaudited deduction regime is exactly designed to produce.

Treasury’s 2023 PRRT Review recommended exactly the fix this Commandment calls for: capping deductible expenditure at 90% of assessable receipts per project, with any denied deductions carried forward at a fixed government bond rate rather than an open-ended uplift — alongside a “Sole Expert Audit” style mechanism to stop the kind of related-party transfer pricing this publication has previously documented in Chevron’s Australian operations, where a Delaware financing subsidiary lent to the local entity at 9% while borrowing at 1.2%, artificially inflating deductible Australian expenses.

Commandment Amended

Expenses are whatever the company reports them to be.

Expenses are capped, audited by an independent expert,
and cannot be manufactured through a related-party loan.

Commandment Four — Domestic Market Obligations

Western Australia is the only Australian jurisdiction with a domestic gas reservation policy at all — the DomGas policy, requiring LNG exporters to make 15% of export volumes available to the WA market.

On paper, that is a real protection. In practice, it has a hole in it large enough to steam an Ultra-Large Crude Carrier [ULCC] export tanker through, sideways!

The 15% figure is calculated as a lifetime average across a project’s operating life, and producers retain full flexibility over when they deliver it. When export prices exceed domestic prices — which they reliably have in recent years — exporters have a direct financial incentive to delay their domestic obligation as long as possible.
The result, according to IEEFA analysis, is that WA LNG exporters were delivering only around 8% domestically by 2023, roughly half of the policy’s headline promise.

Commandment Amended

A dedicated percentage of gas is reserved for Domestic use.

A percentage of gas is delivered domestically on
a fixed annual schedule, with no financial incentive to delay.

Commandment Five — Hybrid Stabilisation Frameworks

Resource contracts in many jurisdictions include “stabilisation clauses” — legal guarantees that the fiscal and regulatory terms a company signed up to won’t be unilaterally changed part-way through a multi-decade project.

These exist for a legitimate reason: nobody invests billions in infrastructure they expect the rules to change on halfway through. The risk is what corporate legal teams routinely try to freeze alongside the fiscal terms — changes in labour standards, environmental protections, and human rights law, locked in at whatever - often weaker - standard existed on the day the contract was signed, immune from any future strengthening of Australian law.

A hybrid model — increasingly the standard recommended by international resource-governance bodies — explicitly carves out labour, environmental and human rights protections from any stabilisation guarantee, while still protecting the fiscal terms investors need certainty on.
Fiscal stability without legal stability of everything else is not sovereignty.
It is a permanent exemption from the country’s own evolving standards, sold as an investment incentive.

Commandment Amended

The contracts terms can never be changed.

The fiscal terms cannot be changed. Australian law can always be strengthened.

Applying All Five Commandments — Together

None of these five Commandments is radical in isolation — every one of them already exists somewhere in the world, in a functioning resource economy, protecting a government’s return on a national asset.
What makes Norway, and even lower-capacity Angola, different from Australia is not that they invented a clever idea Australia lacks access to.
It is that they wrote the protections into the contract before signing it, with enforcement attached, rather than discovering the gap afterward in a tax transparency dataset.

The Perdaman refinery is still at the pre-feasibility stage. That is precisely the window in which these terms are cheapest to negotiate and hardest to walk back from later. Once construction begins, once a Final Investment Decision is signed, the leverage moves permanently to the other side of the table — exactly as it already has at Beetaloo, at Gorgon, and at every other Australian gas project currently returning the country a 0.70% effective tax rate on a public & sovereign resource.

“The windmill will get built either way.

The only open question left, is who owns it when it’s finished.”

For 18 years I was part of the rebuilding effort to get Darwin back into operation.

I have connected that physical devastation to the invisible, fiscal cyclone currently flattening the Northern Territory’s economy — a Category 4 Storm driven by foreign gas corporations paying a mere 0.70% tax rate while extracting billions in resources.

But identifying the trap is only the first step.
To escape it, the Northern Territory needs a strong & powerful legal weapon.

Fortunately, this weapon already exists.
It was forged in the fires of recent global geopolitical shocks, and it is now ready to be deployed — to ensure the Fiscal Survival of the NT.

The Global Precedent: The Geopolitical Shock

In early 2026, the escalating conflict between the US, Israel, and Iran resulted in the closure of the Strait of Hormuz—the world’s most critical oil and gas shipping chokepoint.
The immediate result was a catastrophic disruption to global energy supply chains.

But as Australian Economics Professor Steve Keen highlighted in September 2026, the closure of the Strait has severe downstream production effects that go far beyond oil and gas.

It threatens the supply of indispensable industrial products, such as Sulphuric Acid, which is vital for agriculture, manufacturing, and mining.

The critical production of Sulphuric Acid is just one of the many products severely affected from the continuing closure of the Strait of Hormuz.

Faced with this unprecedented macroeconomic shock, nations worldwide invoked “Force Majeure” — a legal clause that frees both parties from liability or obligation when an extraordinary event or circumstances beyond their control prevents them from fulfilling a contract.

Critically, it wasn’t just the nations directly in the path of the conflict that took this step.

China, Singapore, South Korea, and India — thousands of kilometres away from the Middle East — successfully declared Force Majeure [FM] due to indirect economic disruption.

By declaring Force Majeure, they quarantined themselves from breach of contract obligations, protecting their own economies from global supply chain collapse.

Professor Ilias Bantekas of Hamad bin Khalifa University explained the legal weight of this precedent:

“What we could never have foreseen is that the Strait of Hormuz could be closed to shipping altogether... on its own, this could be sufficient to constitute a Force Majeure event.”

The NT’s Legal Pathway: Connecting the Dots

If sovereign nations thousands of miles away can successfully invoke Force Majeure to protect their economies from indirect global shocks, the Northern Territory can absolutely invoke the same legal doctrines to protect its citizens from fiscal collapse.

The 2026 global geopolitical shock, combined with the NT’s ballooning debt crisis and INPEX’s minimal tax contribution, constitutes a “fundamental change of circumstances.”

The original 2012 fiscal assumptions underpinning the Ichthys LNG Project have been destroyed by unforeseeable global events.

The NT Government has two primary legal pathways forward

1. The Doctrine of Frustration – Australian Common Law.

Under Australian law (Codelfa Construction Pty Ltd v State Rail Authority of NSW), a contract is “frustrated” when a supervening event, without default of either party, makes performance “a thing radically different from that which was undertaken by the contract.”
The NT can argue that the current global macroeconomic environment makes the continuation of the 2008 tax-exempt status radically different from what was originally agreed upon.

2. Sovereign Necessity – International Law

Internationally, the principle of “Sovereign Necessity” permits states to suspend contractual obligations when facing existential fiscal threats.
When a contract threatens the very survival of the state’s capacity to provide basic services to its citizens, the state has the right to invoke necessity.

The Data That Proves Hardship

To invoke these doctrines, the NT must prove that the fiscal hardship is real and that the counterparty — INPEX — is benefiting from windfall profits at the Territory’s expense. The data makes this easy to prove.

While the NT struggles to fund hospitals and schools, INPEX reported a $1.5 billion half-year profit from Ichthys LNG in 2026, driven by spot prices spiking to $23.76 per MM Btu — a 121% increase in just seven months.

There are three more corporations underneath the INPEX umbrella – INPEX Holdings Australia – INPEX SAHUL – INPEX TIMOR SEA, with Michael West Media also having tax data reports, for each one of them via the above links.

For context, Australia’s standard corporate tax rate is 30%.

INPEX Australia Pty Ltd pays less than 1% tax rate.

The Solution: Three Demands for Territorians

The road to prosperity requires the NT Government to stop hiding behind the 2008 Project Development Agreement and take immediate, decisive action.

1. Invoke Sovereign Hardship

The NT Government must formally notify INPEX and its joint venture partners that the 2026 fiscal and geopolitical crisis constitutes a fundamental change of circumstances. They must demand immediate renegotiation of fiscal terms under the Doctrine of Frustration — and — Sovereign Necessity.

2. Demand a Royal Commission

The NT must establish a Royal Commission into gas taxation. This commission must examine:

• The total resources extracted from the Beetaloo Basin and Ichthys LNG.

• The total tax and royalty contributions from foreign corporations.

• The compensation risks under Clause 14 (Fiscal Stability Provisions) and necessary amendments.

• Legal pathways to restructure unfavorable contracts.

3. Legislate Transparency

The NT Parliament must pass a Royalty & Resource Rent Transparency Act, requiring the public disclosure of all fiscal agreements, royalty provisions, and the establishment of a Public Register of Force Majeure Declarations.

The Bottom Line

In 1974 - 75 and onwards, Territorians and Australians from across the country came North and helped rebuild Darwin from a vast vista of catastrophic devastation.

We proved the Territory could overcome physical destruction through national assistance, community spirit, and political will.
Today, we face fiscal devastation — but the enemy isn’t cyclonic winds and torrential rain.
It is complex legal clauses buried within 500-page contracts, protecting “loss of profit” while hospitals and schools age and crumble.

Corporate wolves - busy devouring the NT Treasury’s Lunch

However, the legal landscape has shifted.
China, Singapore, and South Korea have successfully declared Force Majeure due to the indirect effects of Middle East conflicts.

This has created an undeniable legal precedent.

It follows that the Northern Territory has a high probability of success in using this same process to protect its citizens from fiscal collapse.
We rebuilt once. We can rebuild again.
This time, our weapons aren’t engineers, tradies, bulldozers, and cranes.
They’re economists, data analysts, legal arguments, and political will.

The Territory & Territorians deserve better - much better than this.

Australia is at exactly that moment now — the government has just announced its first new oil refinery in sixty years, funded by public money, justified by “fuel security” and “sovereign capability.”

On paper, that is the right instinct. In practice, we are about to build the windmill and hand the keys to someone else, exactly as we did with Commonwealth Oil Refineries, exactly as we do today with the gas beneath the NT’s Beetaloo Basin.

Norway shows there is a different way to build it. So, less obviously, do Brazil and Angola — two countries with far less bargaining power than Australia, who still refused to make the mistake we are about to repeat.

A Refinery, Finally — But Whose?

In late July 2026, Prime Minister Anthony Albanese and WA Premier Roger Cook traveled to Karratha WA, to announce a jointly funded $4 million pre-feasibility study for what would be Australia’s first large-scale new oil refinery since the 1960s.
The proposed builder is Perdaman, a Perth-headquartered fertiliser and industrial chemicals company with, by its own critics’ account, little prior experience in refining.

The announcement sits inside a much larger $15 billion federal fuel security package;

• $7.5 billion for a Fuel and Fertiliser Security Facility,

• $3.2 billion to establish a government-owned Australian Fuel Security Reserve of roughly one billion litres, and a temporary uplift to the Minimum Stockholding Obligation.

The scale of the collapse this is meant to correct is stark. Australia had eight operating oil refineries in 2000. Today there are two — the Ampol Lytton refinery in Queensland and Viva Energy’s Geelong refinery in Victoria — after BP converted its 146,000-barrel-per-day Kwinana plant into a fuel import terminal in 2021.

Even if the Perdaman refinery is built, Australia will still have fewer refineries than half of what it had at the turn of the 21st century, and every one of them privately owned.

Kevin Morrison, an analyst with the Institute for Energy Economics and Financial Analysis, put his finger directly on the structural problem within days of the announcement:

“Australia will still be importing crude oil to process at any new refinery — it is hard to see how it improves Australia’s fuel security position.”

He is right, and the reason he is correct is the same reason Norway does not have this argument at all — because refining capacity without upstream ownership just moves the vulnerability one step down the supply chain.
A refinery you do not own the crude for, built by a company the state has no equity stake in, is not sovereign capability.

It is a second toll booth for someone else’s product and the Aussie citizens will pay for it. Yet, another “Animal Farm” commandment confronts Australians

The Norwegian Answer: Total Ownership, Not Just the Infrastructure

Osprey has covered the headline numbers before — Norway’s $209 billion in annual government oil and gas revenue against Australia’s $16 billion, Norway’s industry expense ratio of 21% of revenue against Australia’s 90%.
What that comparison under-states is why the gap exists. Norway’s state oil company, now Equinor, is 67% owned by the Norwegian state through the Ministry of Trade, Industry and Fisheries, with a separate State’s Direct Financial Interest [SDFI] giving the government its own direct stake in fields, pipelines and facilities on top of that, managed by the state company Petoro.

Net cash flow from the SDFI alone is projected at roughly NOK 262.8 billion in 2026.

Crucially, Norway’s early state planners understood something Australia’s policymakers still have not even come close to comprehending.
Extraction alone was never going to be enough.

As Yale’s own case study on Equinor’s history records, the company’s leadership recognised early that;

“the company would have to be vertically integrated... Statoil’s ability to turn a profit would depend on having market power in the refining and sales part of the value chain as well.”

Australia adopted the UK Privatized model—Vs—Norway — the State-owned Model!

Equinor’s nine onshore plants in Norway, Germany and the UK generated NOK 11.4 billion in goods and services deliveries in a single year, sustaining over 9,055 person-years of employment — ninety percent of those deliveries sourced from Norwegian companies.

This is what vertical integration, under state ownership actually buys, a vibrant country — not just royalties from a hole in the ground, but a vibrant domestic industrial base, built on the top of it all.

What Brazil and Angola Already Know

Here is the part of the Norwegian story most commentary leaves out: Norway is not an isolated case of enlightened self-interest.
Equinor itself operates internationally — including in Brazil and Angola — and in both countries, it has never once taken outright majority ownership of the resource.

In Brazil, Equinor operates as a strategic partner to Petrobras — Brazil’s own state-controlled oil major — in the Roncador field, and to PRIO in the Peregrino field. Equinor’s largest single asset outside Norway, the Bacalhau field, sits inside a $25 billion, 2030-horizon investment program projected to create over 100,000 direct and indirect jobs — but Brazil’s own state company remains the anchor of the country’s upstream sector, not a passive royalty collector watching a foreign major run the show.

In Angola — a country with a fraction of Australia’s institutional capacity, GDP per capita, or global bargaining leverage — the pattern is even clearer, and Equinor’s own website states it in numbers.
Across every Angolan block Equinor holds a stake in, its equity interest never exceeds fifty percent;

• 12% in Block 15,

• 22.8% in Block 29,

• 22.16% in the prolific “Golden Block” 17,

  

• 13.33% in the PSVM development,

• 30% in Block 1/14,

• 40% in Blocks 46 and 47, and,

• an exact 50/50 split at its highest, in Block 31/21.

Angola’s own state oil company, Sonangol, sits across all of it, alongside an independent regulator, the National Agency of Petroleum and Gas [ANPG] — a structure Equinor’s own public materials describe as deliberately modelled on lessons from the Norwegian Continental Shelf.

Pause for reflection — Angola — not a wealthy nation, not a nation with Australia’s diplomatic weight, not a nation anyone holds up as a governance benchmark — still insisted on a state oil company with equity in every block, and a regulator independent of that company, before it let Equinor anywhere near its continental shelf.

Australia’s gas fields have neither. There is no Australian state oil and gas company holding equity in the North West Shelf, in Ichthys, in Barossa, or in the Beetaloo Basin gas INPEX is drilling right now, at the 0.70% average tax rate Osprey documented in The Beetaloo Trap.

Australia’s only claim on any of it is a royalty and a tax rate a foreign company’s own transfer pricing arrangements can quietly whittle down to almost nothing.

The Trap We Are Falling Into — Again!

None of this means the Perdaman refinery shouldn’t be built. Fuel security is real, and the case for domestic refining capacity is real. What Norway, Brazil and Angola demonstrate — three governments with wildly different wealth, institutions and leverage — is that the refinery is not the thing that secures a nation.

The ownership structure underneath it is. Build the Perdaman refinery as a wholly private asset, subsidised only on the downside through the Fuel Security Services Payment and never sharing the upside, and Australia will have spent public money building infrastructure it still does not own, to process crude it still does not control, on behalf of a company incorporated somewhere the Australian Taxation Office cannot easily follow the money.

That is not fuel security.
That is the windmill, rebuilt again, for someone else’s harvest.

September 1973: A Young Man’s Promise

I was twenty years old when I stepped off the plane in Darwin. The heat hit me like a physical force — thick, humid, and utterly foreign to everything I’d known.
The start of the Build-up, before the Monsoon Season.
But I was full of optimism. I’d come to the Northern Territory to serve, to build, to be part of something bigger than myself.

I was promoted from Brisbane and was transferred to the Commonwealth Department of Health — this took me to Darwin Hospital — as a member of the Personnel Department.
Back then, the NT was a frontier town in the best sense of the word.
We were rough around the edges, but there was a spirit here — a sense that we were building a community from the ground up, that every person mattered, that the Territory was worth fighting for. This all suited me fine.

Darwin was Australia’s beautiful, Northernmost Capital City — a gateway to Asia — nobody, had any idea of what was coming.

It was Christmas Eve in the darkness, when Tracy came to Darwin.
Cyclone Tracy didn’t just destroy Darwin. It erased it.

I was at Darwin Hospital when the winds began — hospital staff were celebrating Christmas Eve. We shut the party down & everyone went home — this was serious.
Tracy struck the city in the dark, early Christmas Day.
I’d never heard anything like it —the sound of a Category 4 cyclone tearing through a city is something that stays with you forever.
My ears were aching from the sudden pressure differences.
Concrete cracked. Steel bent.
Buildings that I had passed on the way to work the day before were reduced to rubble.
Homes in the Northern Suburbs & elsewhere — simply blown away!

Over 65 people were killed — Ninety percent of the city’s buildings were destroyed or damaged beyond repair. Over 35,000 people were evacuated in the days that followed.

The hospital still needed to function — locum healthworkers from the South came up to help & they needed us.

Everyone who remained just rolled up their sleeves and we rebuilt.
We also remember all those who came to help.

1975-1978: The Rebuild

The new Darwin rose from the rubble, grew stronger, smarter, more resilient.
We learned from Tracy.
Building codes were rewritten. Infrastructure was hardened. The community bonded in ways that only a shared trauma can forge.

The new Grollo designed homes — cyclone proofing — on steroids!

I stayed for almost twenty years.
Like others, I poured my youth, my energy, and my heart into rebuilding this place.
We all watched it transform from a flattened ruin into a modern city.

Years later, I moved to the South-east Queensland.
I thought I’d left the NT behind me.

I was wrong.

You never really leave the Northern Territory. It gets in your blood - and - stays there.

2026: A New Cyclone — Different but Deadly
